What is crash recovery?

This is where recovery from judgment (or article in this case :)) comes into play. Now you may be wondering “What the hell is recovery from judgment?” Well, the official definition is the compilation of an outstanding judgment by a professional executor of the judgment. Depending on the state you live in, a judgment is valid for between seven and twenty years.

The sad truth is that eighty percent of ALL judgments go unclaimed due to lack of knowledge and experience in recovery procedures. Judgment Recovery is a relatively new industry that is growing rapidly. Okay, now that you know WHAT recovery from judgment is, here’s how the process works:

1. The plaintiff wins his case and receives a court document with the details, including the cash amount.

2. Plaintiff makes several unsuccessful attempts to collect and surrenders (defendant moves out of town, is incarcerated, dies, etc.).

3. Twelve months pass and a professional judgment recovery agent comes across the plaintiff’s file while searching the court’s database.

4. The plaintiff receives a letter stating that the judgment can and WILL BE recovered at no cost to them in advance.

5. The excited plaintiff responds immediately and agrees to the terms of the collection process (Plaintiff will divide the trial specialist’s amount by fifty-fifty).

6. Let’s say in this example that the plaintiff is owed ten thousand dollars, he or she will receive a check for five thousand dollars (The Sentencing Specialist will also receive five thousand dollars for the services rendered)

7. The professional enforcer files a notice of satisfaction of the judgment with the court.

There you have people, that’s what recovery from judgment is all about. With eighty percent of judgments uncollected, there is definitely a need for this particular service. Not paying anything upfront is a BIG advantage. Enforcement specialists tend to prefer to pursue cases that are at least a year old or older. The reason for this is because when people recently won a case less than a year ago, they are generally LESS patient and cooperative when it comes to the terms of recovery. In other words, they want ALL of it or at least ninety percent of the judgment amount.

The world is constantly changing and it is more important than ever that we stay informed. Those people who are delayed will likely be the ones who are NOT aware of current events. For example, ten years ago, there were only three or four functions in the courts (Judge Judy, Judge Mathis, People’s Court, and Divorce Court). There are now at least twice as many judicial programs on television (Judge Alex, Judge Hatcher, Judge Joe Brown, Street Court, etc.).
